Mr. Robinson defends companies in matters involving product liability and consumer actions. His experience includes business and commercial disputes and the defense of manufacturers at trial in numerous federal and state courts.
His litigation successes include the following:
- Obtained summary judgment on a claim for indemnity, contribution, and attorneys fees in a products liability action where the co-defendant refused to accept a tender despite indemnity and contribution clauses in a vendor contract;
- Obtained a jury defense verdict in state court in favor of company that owned and maintained utility poles and where the plaintiff claimed she was injured when an allegedly defective utility pole struck her automobile;
- Obtained a jury defense verdict in state court in favor of a New York City brokerage firm in a suit by a former customer who claimed that the broker “churned” the account and negligently rendered brokerage services;
- Obtained summary judgment in favor of an insurance company against an excess carrier in a declaratory judgment action where the excess carrier claimed that several exclusions in its policy barred coverage;
- Obtained a defense verdict in a state court bench trial in favor of a public works contractor in a dispute over a contract involving a public works project where the plaintiff claimed to be the beneficiary of an implied contract for land use;
- Obtained a plaintiff’s verdict in a state court bench trial in favor of a business owner in a dispute over an alleged breach of contract arising out of a policy of marine insurance where the insurance company alleged that the business owner failed to preserve its subrogation rights and thereby declined coverage; and
- Obtained a defense verdict in a federal court jury trial in favor of a commercial manufacturer in a dispute over an alleged product defect.
Mr. Robinson has extensive appellate experience, including participation in the following matters:
- The Ohio 11th District Court of Appeals, in May, 2003, upheld a trial court decision involving the civil courts’ jurisdiction over a P.U.C.O. matter;
- The Ohio 7th District Court of Appeals, in November, 2007, upheld a trial court decision in a declaratory judgment action, holding an insurance company duty-bound to assume primary liability and defense under its commercial insurance policy against an alleged tort victim’s claim;
- The Ohio 9th District Court of Appeals, in June, 2008, upheld a trial court decision involving a motion to stay and compel arbitration arising out of a commercial dispute; and
- The United States Seventh Circuit Court of Appeals affirmed a trial court’s decision granting summary judgment in a product liability case where there was no evidence as to defect or causation.
- Mr. Robinson also has extensive experience in employment and insurance litigation matters and Consumer Product Safety Commission (CPSC) regulations and compliance. He routinely counsels clients on these matters.
