Creditors' Rights
The Creditors’ Rights group at Wegman, Hessler & Vanderburg is
a team of attorneys and support staff experienced in the area
of creditors’ rights law. Members of this group have
significant experience that provides them with a familiarity
and knowledge of different industries and business practices.
We take a practical, business-oriented approach in
representing our clients. We focus on utilizing our skills and
experience to develop effective approaches necessary to deal
with every facet of the creditor-debtor relationship, both
within and outside of court supervised proceedings.
We assist clients in obtaining judgments, discovering assets of
debtors, and recovering value to satisfy judgment obligations
using state and federal execution processes including, but not
limited to, garnishment, attachment and execution proceedings.
Our Creditors’ Rights group also represents clients in a full
spectrum of bankruptcy matters including, but not limited to:
claims issues, adversary proceedings, executory contract and
lease issues, reclamation proceedings, and plan confirmation
issues. Members of this practice routinely represent secured
creditors, individual creditors, construction clients, and both
publicly-traded and privately-held corporations in
bankruptcy-related matters and in business and other litigation
arising from bankruptcy matters.
We also assist and advise our clients with respect to Uniform
Commercial Code matters, which encompass secured transactions,
commercial paper and negotiable instruments, sales of goods, and
consignment sales.
The Creditors’ Rights group regularly coordinates with Wegman,
Hessler & Vanderburg’s other groups in order to provide our
clients with practical, cost-efficient, and comprehensive
representation.
