E-Discovery & Technology

Recognizing the challenges posed by the adoption of State and Federal Rules of Civil Procedure related to the discovery of electronic information, Wegman, Hessler & Vanderburg established an E-Discovery & Technology Group to counsel and assist the firm’s clients in responding to the growing demands associated with electronically stored information.  The members of our E-Discovery & Technology Group have handled complex litigation involving electronically stored information and are experienced in responding to the challenges clients face in identifying, preserving, collecting and producing electronic information in a cost effective and defensible manner.

The members of our E-Discovery & Technology Group take the time to understand the business, records, and information management systems of each of our clients even before litigation arises.  They counsel clients on electronic and paper records that need to be maintained to comply with applicable rules and avoid the missteps that can prove costly to many corporate clients.   The E-Discovery & Technology Group provides a full range of services for our clients, including:

  • advisement and assistance in the development of records management policies

  • advisement and assistance in the development of policies to enable clients to prepare for litigation even before it arises

  • advisement and assistance in the identification and evaluation of software and other technology systems and providers that can be used to manage electronically stored information in a cost effective manner

  • working with information technology representatives to identify the universe of data which must be preserved in anticipation of litigation

  • guiding clients through the discovery process beginning with litigation holds and document preservation

  • development of electronic discovery plans required under Federal Civil Rule 26(f), and

  • assembly, coordination and management of document review teams and outside vendor support services
