Practice Area Activities 
 

  • Defending product manufacturers at trial in federal and state courts in business and product liability litigation.
  • Defense of civil jury trials including premises liability, non-compete agreements, arbitration agreements.
  • Additional litigation experience includes employment law, insurance law, vendor disputes, municipal law, contract issues and collections issues.
  • Assist manufacturers on dealings with the Consumer Product Safety Commission (CPSC) regulations and advise as to compliance.

Representative Matters

  • Obtained summary judgment in favor of defendant against co-defendant for indemnity, contribution, and attorneys fees in a lawsuit claiming products liability. The co-defendant refused to tender a defense despite indemnity and contribution clauses in a vendor contract.

  • Obtained a jury defense verdict in state court in favor of company that owned and maintained utility poles. The plaintiff claimed that she was injured when an allegedly defective utility pole struck her automobile.

  • Obtained a jury defense verdict in state court in favor of a New York City brokerage firm in suit by a former customer who lost approximately money in the stock market. The former customer claimed that the broker “churned” the account and negligently rendered brokerage services.

  • Obtained summary judgment in favor of defendant insurance company against co-defendant excess carrier insurance company in declaratory judgment action. The co-defendant excess carrier insurance company alleged, unsuccessfully, that several exclusions in its policy barred coverage.

  • Obtained a defense verdict in state court bench trial in favor of business owner for $73,500.00 plus interest in a dispute over an alleged breach of contract arising out of a policy of marine insurance. The insurance company alleged that the business owner failed to preserve its subrogation rights and thereby declined coverage.

  • Obtained a defense verdict in state court bench trial in favor of a rural physicians practice group in a dispute over an alleged breach of covenant not-to-compete.  The trial court issued an injunction barring the defendant from unlawfully competing within a five mile radius.
