Update: Tax Lawsuit Moves Forward Ensuring A Day in Court to Challenge the Unconstitutional Taxation of Remote Workers

On September 29, 2021, Cuyahoga County Court Judge Dick Ambrose denied the City of Cleveland’s Motion to Dismiss Morsy v. Dumas.  The ruling ensures that Dr. Manal Morsy will have her day in court and will be able to challenge the city’s unconstitutional taxation of people who do not live in Cleveland.

In April of 2021, Jay Carson, on behalf of Wegman client The Buckeye Institute filed a lawsuit against the City of Cleveland on behalf of Pennsylvania resident, Dr. Morsy.  The suit challenges the city’s income tax imposed on Dr. Morsy since she has not worked in the city for over a year.
